According to the current policy, any e-commerce platform with foreign investment cannot exercise ownership or control over the inventory sold on its platform. This may prove to be a threat to Originals coming from global OTT platforms.

 

The draft states that e-commerce includes buying, selling, marketing or distribution of goods, including digital products and services, through an electronic network. Delivery of goods, including digital products, and services either online or through physical means have also been covered under this clause.

Direct sellers affected by discounts of e-commerce sites

Steep discounts being offered by e-commerce platforms such as Amazon, Flipkart and Snapdeal has adversely affected the actual sales by direct sellers. The Delhi High Court ruled earlier this week that these platforms cannot sell products owned by these sellers without prior authorisation. The court further said e-commerce platforms have the obligation to maintain the sanctity of contracts and should not encourage or induce a breach.

Ban on unfair prices and fake reviews: New Rules

The Department of Consumer Affairs, under the Ministry of Consumer Affairs, Food and Public Distribution, released the draft of Consumer Protection (E-Commerce) Rules 2019. It states an e-commerce entity cannot influence the price of goods and services, adopt unfair trade practices, or even leave fake reviews as consumers. The draft rules are open for consultation from stakeholders for 21 days, that is, until December 2, 2019.

The Competition Commission of India has advocated that e-commerce players have self-regulation by increase in transparency in search rankings, collection and use the data and user review and rating mechanism. Netflix rolls out ‘Downloads For You’

Streaming giant Netflix has rolled out a new feature that will automatically download movies and TV shows. The new ‘Downloads for You’ feature will help users in situations where they find themselves stuck without Internet access or in a long commute. According to Mashable, previously, the Smart Downloads feature on Netflix would automatically delete the episodes a user has watched and would download the next episode of the said TV series. However, this left Netflix movies without an automatic download feature.Now, the new ‘Downloads For You’ feature will allow users to automatically download Netflix episodes and movies in order to watch later. This feature is only available for Netflix Android app for now and it is not known when iOS or iPadOS users will get the new feature. The ‘Downloads For You’ feature is an opt-in feature that can be turned on inside the Netflix app.
